AWAY FROM THE ORDINARY LTD. BOOKING TERMS AND CONDITIONS 2024

Making A Booking Complete and sign the Booking Form accepting the conditions of Away From The Ordinary Ltd., Summit House, 4 – 5 Mitchell Street, Edinburgh, EH6 7BD, Scotland. These booking conditions form the basis of your contract. No contract exists until a completed booking form and deposit have been received and we will then issue a confirmation of booking. This contract is made on the terms of these booking conditions which are governed by Scottish law. You may however choose the law and jurisdiction of England, Wales or Northern Ireland if you live there and wish to do so. The lead traveller must be at least 18 years old, and a deposit of 30% of the agreed total is required at time of booking. Full payment of the remaining 70% is due 8 weeks prior to departure. A reminder is not sent to you, it is your responsibility to forward balance on the due date, shown on your invoice. The right is reserved to cancel any bookings not paid by the due date.

On Receipt Of Your Deposit We make the necessary reservation and your deposit is accepted in part payment of the agreed cost of the booking and is credited to your account. The contract exists between us after you have received a confirmation invoice, normally within 7 days, which should be checked and queried if not in order. We shall not be liable if any of the information is incorrect if you have not notified us within 7 days of receipt.
Major Change Great care has been taken to ensure that your vacation/holiday is of great quality, however if any changes to your vacation/holiday are necessary, due to circumstances beyond our control, we would advise you prior to departure. Where major changes are necessary, we would offer a full refund.

If We Change Your Vacation/Holiday We plan the arrangements for vacations/holidays in advance and although it is unlikely that we will have to make any changes to confirmed arrangements, it does occasionally happen. We reserve the right to make such changes at any time. Most changes are of a minor nature and we will advise you as soon as possible before your departure. Sometimes major changes are necessary to your accommodation. Major changes include the following:

Change of accommodation to that of a cheaper price (see Cancellation) If we have to make a major change to your vacation/holiday you may either:

  1. (a)  accept the changed arrangements
  2. (b)  Cancel your vacation/holiday

If you choose either (a) you will also be offered a credit towards the costs of your vacation/holiday as shown below:

  1. (i)  Changes more than 56 days before departure – NIL
  2. (ii)  Changes between 55 – 29 days before departure – £20 per person (iii) changes between 28 –15 days – £30 per person

(iv) Changes between 14 – 8 days before departure – £40 per person (v) changes less than 7 days before departure £50 per person If you choose (b) we will refund all monies paid.
Could I Be Refused Entry? There are a number of reasons for which you could be refused entry:
(a) If you do not hold a valid passport and/or visa required for entry into or exit from the country of origin or destination.

(b) If in the opinion of a person in authority you appear to be unfit to travel or likely to cause discomfort or disturbance to other passengers our responsibility for your vacation/holiday will immediately cease. We will not be responsible for any costs you may incur or make refunds to you.

Misbehaviour We reserve the right at our absolute discretion to terminate without notice the vacation/holiday arrangements of any customer whose behaviour is such that it is likely in our opinion to cause distress, damage or annoyance to our customers, employees, property or to any third party. Full cancellation charges will apply, and we will be under no obligation whatsoever to provide a refund or compensation for costs which may be incurred. Away From The Ordinary Ltd. has no control over the behaviour of person staying at, or visiting your vacation/holiday accommodation and is not responsible for any withdrawal or impairment of facilities or other loss or damage caused by them.

Passports, Visas & Travel Documents Please check that your passport is valid for at least 6 months after the entire duration of your vacation/holiday with the appropriate Embassy. If you are not a British passport holder you may require a visa, please check before booking your vacation/holiday. All passport, visa, travel insurance, health certificate requirements and Foreign Office advice are your responsibility. Away From The Ordinary Ltd. accept no responsibility for any delay or expense incurred through any irregularity in your documents

Independent Suppliers Away From The Ordinary Ltd. secures transportation, hotel accommodations, activities, meals, and air from various independent suppliers, who are not affiliated with Away From The Ordinary Ltd. Although we choose the best suppliers available, Away From The Ordinary Ltd. Does not have total control over their operations and cannot, therefore, be liable for any personal injury or property damage which may occur due to (1) wrongful, negligent or arbitrary acts of omissions on the part of a supplier, its employees and others not under the direct control of Away From The Ordinary Ltd. or (2) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers.

Optional activities Optional activities will be furnished by independent suppliers who are not affiliated with Away From The Ordinary Ltd. in any way. Some of these activities carry inherent risks, these activities include but are not limited to: walking; mountaineering; kayaking; cycling; and horseback rides. You should be aware that, although precautions are taken to guard against such dangers, your safety cannot be guaranteed. Should you elect to participate in such activities while you are on your tour, you must understand that such participation will be at your own risk, and that Away From The Ordinary Ltd. can assume no responsibility for your safety. Away From The Ordinary Ltd. requests common sense and caution be exercised during your travels.

Late Bookings For all bookings made within 8 weeks of departure, the full amount of the vacation/holiday price is required with the booking form.
Force Majeure We cannot accept liability in any circumstances where performance and/or prompt performance of the contract is prevented by reasons of war, threat of war, civil strife, riots, terrorist activities, industrial disputes, natural and nuclear disaster, fire or adverse weather conditions.
Accommodation The accommodation booked is reserved exclusively for the persons named on the booking form. Subletting or assignment or sharing is not permitted. All damages and breakages will be charged to the client and must be paid before vacating the property.
Accommodation Arrival and Departure Most accommodation check ins are after 3pm on the day of arrival and ceases at 11am on the day of departure. Price Guarantee The price of your vacation/holiday, once confirmed, is guaranteed unless both parties agree to any changes. However, in the event of substantial changes in local taxes, or exchange rates, these charges would be passed to the client. Away From The Ordinary Ltd. would absorb the first 2% of any increase where a vacation/holiday has been confirmed.
If You Have A Problem In the very unlikely event that you have a problem or complaint during your vacation/holiday, please notify a representative of Away From The Ordinary Ltd. immediately, so that they have an opportunity to rectify the issue. If this is proven unsatisfactory then the client should notify Away From The Ordinary Ltd. in writing within 28 days of the completion of his/her vacation/holiday. No liability can be accepted for complaints not notified within that period or if the complaint was not notified to an Away From The Ordinary Ltd. representative during the vacation/holiday.

Cancellations If it becomes necessary for you or any member of your party to cancel your booking or part of it, you must inform us in writing immediately. Cancellation charges are calculated from the date we receive written notification in our office. When we receive the written notification then cancellations are subject to the following penalties of the full trip price:

Data Protection Policy In order to process your booking and to ensure that your travel arrangements run smoothly, Away From The Ordinary Ltd. requires to use the information you provide e.g. name, address and special needs/dietary requirements/medical conditions. We only pass this information to relevant suppliers of your travel arrangements such as the car hire company, hotels and restaurants. We will not pass on any information to persons not part of your travel arrangements. We will hold your information where collected by us and may use it to inform you of offers in the future. You are entitled to a copy of the information held by us.

Insurance Travel insurance is highly recommended and should be purchased within 10 days of deposit. You should carry comprehensive travel and medical insurance to cover yourselves, as well as travelling companions. Away From The Ordinary Ltd. strongly recommends travel insurance to include trip cancellation and interruption, accidental death, disability, emergency medical evacuation, major medical and loss of personal effects, and repatriation. Away From The Ordinary Ltd. including their representatives and agents can take no responsibility for any costs, losses incurred by the traveller, or traveller’s dependents or travelling companions.

Away From The Ordinary Ltd. is covered by a Tour Operators Combined Liability Insurance policy.
